Welcome to LUMIBRI! The terms "we", "us" and "our" refer to LUMIBRI. LUMIBRI operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a carefully curated shopping experience (the "Services"). LUMIBRI is powered by Shopify, which enables us to provide the Services to you.

The following terms, together with the policies referred to in this document (the "Terms of Service" or the "Terms"), describe your rights and obligations when using the Services.

Please read these Terms of Service carefully, as they contain important information about your legal rights.

By visiting, interacting with or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or the Privacy Policy, you should not use or access the Services.

By agreeing to these Terms of Service, you represent that you have reached the age of majority in your state or province of residence, and that you have given us your consent to allow any minors in your care to use the Services on devices that you own, purchase or manage.

To use the Services, including accessing our online stores, viewing their content or purchasing the products and services we offer, you may be required to provide certain information, such as your email address, payment details and address. You represent and warrant that all information you provide in our stores is correct, current and complete, and that you have all the rights necessary to provide it.

You are solely responsible for maintaining the security of your credentials and for all activity that takes place on your account. You may not transfer, sell, assign or grant a license to use your account to any other person.

Section 2 — Our Products

We have made every effort to display our products and services as accurately as possible in our online stores. However, the colors or appearance of products may differ from what appears on your screen, depending on the device you use to access the store and its settings and configuration.

Possible differences in color display due to your screen do not limit your right to receive a product that matches the description and the agreed characteristics.

All product descriptions are subject to change at any time, without notice and at our sole discretion. We reserve the right to discontinue any product at any time and to limit, on a case-by-case basis, the quantities of any product we offer to any person, geographic region or jurisdiction.

Section 3 — Orders

By placing an order, you submit an offer to purchase. LUMIBRI reserves the right to accept or reject your order for any reason and at its discretion. Your order will be considered accepted only when LUMIBRI confirms its acceptance. We must receive and process your payment before accepting the order.

Please review your order carefully before submitting it, as LUMIBRI may not be able to accommodate cancellation requests once the order has been accepted. If we reject, modify or cancel an order, we will try to notify you using the email address, billing address or phone number provided when the order was placed.

Your purchases are subject to return or exchange in accordance with our Refund Policy, without prejudice to the rights granted to you by applicable law.

You represent and warrant that your purchases are intended for your personal or household use, and not for commercial resale or export.

Section 4 — Prices and Payments

Prices are displayed in euros and include VAT and other applicable taxes. Shipping costs, where applicable, are shown separately before you confirm and pay for your order.

Before completing your purchase, you will be able to review the total amount, including taxes, shipping costs and any applicable discounts. No optional paid services will be added without your express consent.

Prices and promotions may change for future purchases. These changes will not affect orders that have already been confirmed.

Payments are made using the methods available at checkout. You must provide correct purchase and billing details and be authorized to use the chosen payment method.

Section 5 — Shipping and Delivery

Available destinations, shipping costs and delivery times are set out in our Shipping Policy and during the checkout process.

Unless a different period is stated before you place your order, orders are prepared within 1–2 business days and delivery is estimated at 7–14 business days from dispatch, depending on the destination.

If there is a problem or delay, please contact us at info@lumibri.store. We will handle the issue with the carrier and keep you informed of its progress.

When transport is arranged by LUMIBRI, we bear the risk of loss or damage until you, or a person you have designated other than the carrier, physically receive the products.

If you arrange your own carrier that was not proposed by LUMIBRI, the specific legal rules on the transfer of risk will apply.

Delays do not remove your rights. If we do not deliver within the agreed period, you may give us a reasonable additional period and, if that is not met either, terminate the contract and obtain the corresponding refund. It will not be necessary to give an additional period in the cases provided for by law, such as a refusal to deliver or failure to meet an agreed essential delivery date.

Section 6 — Intellectual Property

Our Services, including but not limited to all trademarks, trade names, text, images, graphics, product reviews, video and audio, as well as their design, selection and arrangement, belong to LUMIBRI, its affiliates or its licensors, and are protected by the laws of the United States and other countries on patents, copyright and other intellectual property rights.

These Terms permit you to use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify, create derivative works from, publicly display or perform, republish, download, store or transmit any material available on the Services without our prior written consent.

Except as expressly provided in these Terms, nothing grants, or should be interpreted as granting, a license or other rights over the patents, trademarks, copyrights or other intellectual property of LUMIBRI, Shopify or third parties. Unauthorized use of the Services may violate federal and state intellectual property laws. LUMIBRI reserves all rights not expressly granted in these Terms.

The names, logos, product and service names, designs and slogans of LUMIBRI are trademarks of LUMIBRI, its affiliates or its licensors. You must not use them without the prior written authorization of LUMIBRI.

The name, logo, product and service names, designs and slogans of Shopify are trademarks of Shopify. All other names, logos, product and service names, designs and slogans that appear on the Services are trademarks of their respective owners.

Section 7 — Optional Tools

As part of the Services, you may have access to customer tools offered by third parties that we do not monitor and over which we have no control.

You acknowledge and agree that we provide access to such tools "as is" and "as available", without warranties, representations or conditions of any kind and without endorsing them. We assume no liability arising from or relating to your use of optional third-party tools.

Any use you make of optional tools offered through the site is entirely at your own risk and discretion. You must make sure you are familiar with and accept the terms on which the relevant third-party providers offer those tools.

In the future, we may also offer new features through the Services, including the launch of new tools and resources. These features will also form part of the Services and will be subject to these Terms of Service.

Section 9 — Relationship with Shopify

LUMIBRI is powered by Shopify, which enables us to provide the Services to you. However, any purchase or sale you make in our store is made directly with LUMIBRI.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales made between you and LUMIBRI, including any injury, damage or loss arising from the products and services purchased.

You hereby expressly release Shopify and its affiliates from all claims, losses and liabilities arising out of or relating to your purchases and transactions with LUMIBRI.

Section 10 — Privacy Policy

All personal information we collect through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify's Privacy Policy.

By using the Services, you confirm that you have read these privacy policies.

We may, for example, exercise the rights under this license to manage, provide, evaluate, improve and promote the Services, and to fulfill our obligations and exercise our rights under these Terms of Service.

You also represent and warrant that: (i) you own or have all the necessary rights to your Submissions; (ii) you have disclosed any compensation or incentive received for providing them; and (iii) your Submissions will comply with these Terms.

We are not obligated to: (1) keep your Submissions confidential; (2) pay you compensation for them; or (3) respond to your Submissions.

We may, but are not obligated to, monitor, edit or remove Submissions that, in our sole discretion, we consider unlawful, offensive, threatening, defamatory, libelous, pornographic, obscene or otherwise unacceptable, or that infringe the intellectual property of any party or these Terms of Service.

You agree that your Submissions will not violate the rights of third parties, including copyright, trademark, privacy, personality rights or other personal or proprietary rights.

You also agree that your Submissions will not contain defamatory, unlawful, abusive or obscene statements, or computer viruses or other malicious software that could in any way affect the operation of the Services or any related website.

You may not use a false email address, impersonate another person, or mislead us or third parties as to the origin of any Submissions. You are fully responsible for the Submissions you make and their accuracy. We assume no responsibility for Submissions posted by you or by third parties.

Section 12 — Errors, Inaccuracies and Omissions

Occasionally, the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, offers, shipping costs, delivery times or product availability.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time and without prior notice, including after you have placed an order.

You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly:

(i) to engage in any other activity that limits or prevents others from using or enjoying the Services, or that, in our judgment, may harm LUMIBRI, Shopify or users of the Services, or expose them to liability.

In addition, you agree not to:

(a) upload or transmit viruses or other malicious code that affects or may affect the functionality or operation of the Services;

(b) reproduce, duplicate, copy, extract, sell, resell or exploit any part of the Services;

(c) collect or track the personal information of others;

(d) spam, phish, pharm or use deceptive pretexts in connection with the Services;

(e) use robots, web crawlers, data collection and extraction tools, automatic devices or processes, artificial intelligence tools — such as agent-based AI — or other automated or manual means to access the Services; or

(f) interfere with the security or authorization features, robot exclusion headers or other measures we use to limit access to the Services, or circumvent or bypass them.

We reserve the right to suspend, block or terminate your account at any time and without notice if we determine that you have breached any provision of these Terms.

Section 14 — Agents

14.1 This section (the "Agent Terms") applies if you use, authorize, enable or initiate the deployment of an Agent to access, use or interact with the Services. "Agent" means any software or service that performs autonomous or semi-autonomous actions on behalf of, or at the direction of, a person or entity and that may run on behalf of a person or using their device without direct supervision.

14.2 No Agent may access, use or interact with the Services unless it identifies itself on an ongoing basis and strictly complies with the requirements of section 14.4. In addition, no Agent may access, use or interact with the Services if we have asked it to refrain from doing so.

14.3 We may restrict, including through technical measures, the access, use and interaction of any Agent with the Services.

14.4 Agents must:

(i) indicate in all HTTP/HTTPS requests that the request comes from an Agent and identify its name by including "Agent/[agent name]" in the request's user agent string;

(ii) not hide or disguise that the access, use or interaction is carried out through an Agent, for example by imitating human behavior or interaction patterns, or by solving or bypassing CAPTCHAs or measures designed to distinguish between computer and human use;

(iii) respond truthfully to any question or request intended to determine whether an interaction comes from a person or a computer; and

(iv) not circumvent or evade measures designed to block, restrict, modify or control the access, use or interaction of Agents with the Services.

Section 15 — Termination

We may terminate this agreement or end your access to the Services, or to any part of them, at our sole discretion, at any time and without notice. You will remain liable for all amounts owed up to and including the date of termination.

The following sections will survive any termination: Intellectual Property; Comments and Submissions; Termination; Legal Guarantee and Conformity; Liability; Indemnification; Severability; No Waiver and Entire Agreement; Assignment; Governing Law and Jurisdiction; Privacy Policy; and any other provision that, by its nature, should survive termination.

Section 16 — Legal Guarantee and Conformity

Products must conform to the description and the agreed characteristics and meet the legal requirements of conformity.

Under Spanish law, LUMIBRI is liable for any lack of conformity of new goods that exists at the time of delivery and becomes apparent within the following three years.

If a product has a lack of conformity, you may contact info@lumibri.store, stating your order number and describing the problem.

You may request free repair or replacement, unless the chosen option is impossible or disproportionate within the terms provided by law. Where applicable, you will be entitled to a price reduction or to terminate the contract and receive a refund.

Remedial measures will be carried out within a reasonable time and without significant inconvenience, and will include the necessary costs of transport, materials and labor.

Any additional commercial guarantee will supplement these rights and will not replace or limit them. The legal guarantee is independent of the right of withdrawal.

Section 17 — Liability

LUMIBRI will be liable in accordance with applicable law for the breach of its obligations.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, nor the non-waivable rights of consumers, including those relating to defective products, lack of conformity and personal injury.

The involvement of suppliers, carriers or technology platforms does not remove the obligations that fall on LUMIBRI as the seller.

Section 18 — Indemnification

You agree to indemnify, defend and hold harmless LUMIBRI, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, asserted by third parties in connection with:

(1) your breach of these Terms of Service or of the documents incorporated by reference;

(2) your violation of any law or of the rights of third parties; or

(3) your access to and use of the Services.

We will notify you of any claim subject to indemnification. Failure to notify you promptly will not release you from your obligations, unless it causes you significant prejudice.

We may assume control of the defense and settlement of such a claim at your expense, including the choice of counsel. However, we will not agree to a settlement that imposes non-monetary obligations on you without your consent, which must not be unreasonably withheld.

You will cooperate in the defense of claims subject to indemnification, including by providing the relevant documents.

Section 19 — Severability

If any provision of these Terms of Service is determined to be unlawful, invalid or unenforceable, that provision will be enforceable to the fullest extent permitted by applicable law, and the unenforceable part will be deemed severed from these Terms of Service.

This determination will not affect the validity and enforceability of the remaining provisions.

Section 20 — No Waiver and Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms of Service will not constitute a waiver of that right or provision.

These Terms of Service, together with any policies or operating rules we post on this site or in connection with the Services, constitute the entire agreement between you and us and govern your use of the Services.

They supersede any prior or contemporaneous agreements, communications or proposals, whether oral or written, between you and us, including any prior versions of the Terms of Service.

Any ambiguities in the interpretation of these Terms of Service will not be construed against the drafting party.

Section 21 — Assignment

You may not delegate, transfer or assign this agreement or any of your rights or obligations under these Terms without our prior written consent. Any attempt to do so will be void.

We may transfer, assign or delegate these Terms and our rights and obligations without your consent and without notifying you.

Section 22 — Governing Law and Jurisdiction

These Terms are governed by Spanish law.

If you habitually reside in another country, this choice will not deprive you of the protection granted to you by the mandatory provisions of the law applicable to your contract as a consumer.

Disputes will be submitted to the competent courts in accordance with applicable regulations, including those of your place of residence where appropriate. No exclusive submission to the courts of LUMIBRI's place of business is established.

Section 23 — Headings

The headings used in this agreement are included for ease of reading only and will not otherwise limit or affect these Terms.

You can review the most current version of the Terms of Service at any time on this page.

We reserve the right, at our sole discretion, to update, modify or replace any part of these Terms of Service by posting updates and changes on our website. It is your responsibility to check the site periodically for changes.

We will notify you of any material change to these Terms in accordance with applicable law. Such changes will take effect on the date stated in the notice.

Your continued use of or access to the Services after the posting of any changes to these Terms of Service constitutes acceptance of those changes.
